Tourist rental licence in Alicante and the Costa Blanca: check it before you rent or buy

Do you want to let your Spanish home to tourists? In the Valencian Community, letting a whole home for 10 days or less needs registration with the regional tourism register and a favourable report from your town hall. Your council or your community of owners can say no, so check before you spend money on a rental or on a purchase.

Sol-4 Gestión checks the rules for your property, prepares the paperwork and tells you where you stand, in English.

What counts as a tourist rental in the Valencian Community

  • A whole home, let for money, for tourist purposes, for 10 days or less in a row to the same guest. That is what Valencian law calls a tourist-use home (vivienda de uso turístico, or VUT).
  • Stays of 11 days or more are a different regime. They fall under ordinary tenancy law, not the tourist register.
  • Letting by the room to tourists is not allowed. The law forbids it expressly.

You will see Spanish terms along the way: declaración responsable (a sworn declaration you file online), informe de compatibilidad urbanística (the town hall's report on whether tourist use is allowed at that address) and Registro de Turismo (the regional tourism register).

What you need before you can register

01

A favourable report from your town hall

The town hall must confirm that tourist use is compatible with the planning rules for your address. A favourable report does not replace any other licence the property needs.

02

A council that still accepts new tourist homes

Councils can limit the number of tourist homes by area or by building, using objective criteria. Some have frozen new ones. Alicante city, for example, has had a two-year suspension on new tourist licences since early 2025. Rules differ council by council, so we ask your town hall first.

03

A community of owners that allows it

In a building with a community of owners, the community can approve, limit, condition or prohibit tourist rentals. That decision needs the votes of three fifths of the owners, who must also hold three fifths of the ownership shares. This rule has applied since 3 April 2025. We read your community's statutes and minutes before you apply.

04

The property's own cadastral reference

The declaration and the rental contracts must carry the single cadastral reference of the property.

05

The minimum standards for tourist homes

Valencian rules set minimum quality, safety and accessibility standards, including liability insurance and house rules for guests.

06

The declaration and the registration number

You file the declaración responsable online and receive a registration number. It is valid for five years, then it must be renewed. The number must appear in your advertising.

After you register

  • Advertise with your registration number and the exact location. Leaving them out is an infringement.
  • Register your guests with the police reporting system for tourist accommodation (SES.Hospedajes).
  • Renew before the five years end. If you do not, the registration is cancelled.
  • Tell the tourism authority if the holder changes. Not doing so is also an infringement.
  • Know who is liable. Fines are set by the regional rules, and an owner can be held liable if they do not identify who runs the activity when the authority asks. Councils can take on the power to sanction.

Tax on tourist rental income if you live abroad

Rent from a Spanish property is taxable in Spain. If you live outside Spain, you declare it on the non-resident return (Modelo 210). If you live in the EU, Iceland or Norway, you can deduct expenses directly linked to the Spanish income. If you live elsewhere, you declare the gross rent. If you offer hotel-type services such as cleaning or laundry, the tax treatment can change, so tell us what you provide. See non-resident tax in Spain.

Buying a property that already has a tourist registration

A listing that says "tourist licence included" is not proof. Do not assume the registration passes to you automatically. A change of holder must be notified to the tourism authority, and the registration must still be valid. Before you sign, we check the register, the town hall report and the community's rules, together with the urban legal checks we run on every purchase. See also buying property in Spain.

Who this is for, and who it is not for

This is for you if

  • You own a home on the Costa Blanca and want to let it to tourists.
  • You are buying a home and plan to let it, or the listing says it has a tourist licence.
  • You already let it and want to check where you stand.

This is not the right page if

  • You let for 11 days or more, or on a long-term tenancy. Different rules apply.
  • You plan to let by the room to tourists. The law does not allow it.
  • You want someone to advertise your home or look after your guests. We handle the legal and tax side. Running the rental is up to you or your rental manager.

Fees

We quote after we have checked your address, because the work depends on your town hall and your building.
